EayOK Hosting Services (AKA: EayOK
Hosting & More, EayOK Hosting on the Net, eayok.net and eayok.biz) provides
hosting space for your domains names (your website). It is owned and
operated by Oksana Studios. Your domain hosting and/or membership to
"members only" payment on your account (s) are made payable to Oksana
Studios. Oksana Studios is a
graphic business and a separate entity with it's own terms and
conditions. This section will be known or noted as Terms & Conditions,
Acceptance Policy or Agreement. This agreement will govern your purchase
and use of any EayOK Hosting and/or EayOK Members Only (collectively
called "Plan (s)". Your account will also be referred to as your "Plan
(s)" as described in the Order Form, ordered by you and accepted by
EayOK Hosting (eayok.net, eayok.biz). Your website will on on
eayok.net's servers. Our website is eayok.biz with other terms &
conditions supplied in the website on eayok.net servers. It is required
that you accept these terms and conditions in order to register on the
Client Registration page and
use the Plan (s). By making your payment means that you "have read,
understood and accept the EayOK Hosting Serives Terms and Conditions"
and you agree to be bound by the terms and conditions contained in this
document as well as all policies and guidelines incorporated by
reference. You agree that the act of submitting your order form online
is equivalent to your signature. You agree that all the information you
submit online is true and correct. Whether you choose a "Hosting Plan or
MembersOnly Plan" the below applies to you.
EayOK Hosting Services reserves the
right to change this document as deemed necessary at any time. Should
this occur, notification will be given in this manner: email or
displayed as "News" in your control panel or posted on this site.
Requirement for Hosting Plans:
All subscribers must register
first on. Use of the Hosting Plan/Subscription requires a certain
amount of knowledge in the use of Internet Programming Languages,
protocols and software, etc... This knowledge will vary depending on the
usage and content level of your website. You or your webmaster must have
the knowledge necessary to maintain your website, as it is not EayOK
Hosting Services responsibility to advise, teach, supply or provide any
such knowledge or customer support outside of the Plan (s) agreed to you
by EayOK Hosting Services (EayOK Hosting on the Net).
Acceptable Use for Hosting Plans:
Use your common sense as a guide to acceptable
use of EayOK Hosting Services and our servers. Also see the next two paragraphs
below. EayOK Hosting Services reserves the right to terminate your Subscription
(s) without prior notice if you, in any way, should you violate any part of the
Guidelines set on any page in eayok.biz, or this Agreement.
Unacceptable Use for Hosting Plans: You shall not use the
hosting plans in any way that violates U.S State Laws, Federal Laws and U.S. export laws, including without
limitation, uses related to the distribution of weapons of mass destruction,
prohibited chemical, biological, or nuclear weapons or missile use. You agree
that you are not located in, under control of, or a national or resident of any
country restricted as a destination by US law or on the US Treasury Department's
list of Specially Designated Nationals or the US Department of Commerce's Table
of Denial Orders.
Unacceptable Content for Hosting Plans:
You are
NOT allowed any of the following content to be stored on EayOK.net servers:
Illegal Material - Includes copyrighted works, non copyrighted works, commercial
audio, warez, video, or music files, audio streaming, "file dumping" and any
material in violation of any Federal, State or Local regulation

"file dumping"
The posting of files for download or storing of files for distribution
commercial or non commercial.

Chat scripts or Irc bots, spamming activities and message boards.
- Any Audio or Video Files. These
files eat server resources. If you should require a site for your
audio or video files, make sure that they are your own and not someone
else's copyrighted material. Then email EayOk Hosting Services,
with the purpose of this kind of website. We will email you back and
let you know the extra cost if any and availability of this kind of
space.
- Any content that is considered to be
offensive. This includes but is not limited to pornography and
sex-related merchandising.
Adult Material - Includes all pornography,
erotic images, or otherwise lewd or obscene content. The designation
of "adult material" is left entirely to the discretion of
EayOK Hosting & More.
- CGI based Forums/BBS
- Software downloads, unless created
by the client.
Also prohibited are sites that promote any illegal activity or present
content that may be damaging to Eayok Hosting Services servers or
any other server on the internet. Links to such materials are also
prohibited.
Examples of unacceptable content or links:
- Pirated software
- Hacker programs or archives
- Warez sites
Warez - Includes
pirated software, ROMS, emulators, phreaking, hacking, password cracking. IP
spoofing, etc., and encrypting of any of the above. Also includes any sites
which provide "links to" or "how to" information about such material.
EayOK Hosting Services and/or Oksana Studios, will be the sole
arbiter as to what constitutes a violation of this provision.
If at any time your account or accounts becomes a threat to the
server or the network by using to many resources, which then causes
discomfort to the other accounts being hosted on the same server, then
we reserve the right to request that a limit be placed on the account
and any transfer overage be paid for or be removed from the server.
System And Network Security
Any attempt to undermine or cause harm to a server, or other hosting customers
of EayOK Hosting Services, is strictly prohibited.
Subscription Term:
This agreement will be for the "term" of twelve
(12), beginning from the moment you register for the Subscription (s) whether
you pay for the year or by the month - This agreement term is also reflected in
other pages of eayok.biz, with current terms. This agreement and your
Subscription (s) will be automatically renewed at the expiration of the term
unless you followed the instructions described in the Termination Policy
(Termination Instructions) below.
Termination Instructions: To terminate
(cancel) your Hosting Plan, you must provide EayOK Hosting Services written
documentation for your termination from our servers by fax or email. EayOK
Hosting Services will then ask you for customer identification information so
that we can properly identify you and delete your plan (s) from our servers.
Payment:
All charges for your Subscription (s) must be
paid in advance according to the most current price of the Subscription (s).
Upon registration, you must pay for your Subscription (s) through our current
merchant. Upon paying for your Subscription (s), you thereby grant permission to
EayOK Hosting Services to charge any fees in accordance with your Subscription
(s). Your Subscription will be renewed by you before your renewal date. If you
do not get an automatic renewal from our merchant, you must make sure you go to
EayOK Hosting Services (eayok.biz) Choose
Hosting Plan and pay for your subscription. You may also email us,

a request to send you an email payment link.
Disclaimer:
You acknowledge and agree that EayOK
Hosting Services accepts no responsibility or liability for, and employs
no control over, the content of the information passing through
eayok.biz host servers, network hubs, or the Internet. All services
performed thereunder are performed "as is" and without warranty against
failure of performance including, without limiting to, any failure due
to computer hardware or communication systems.
It is also your responsibility to have
your own virus protection on your computer for our server protection and
your own protection in downloading and uploading files.
Warranties and Representation:
Disclaimer
- EayOK Hosting Services cannot be held liable for system downtime,
crashes, or data loss. We cannot be held liable for any predicted
estimate of profits in which a client would have gained if their site
was functioning. Certain services provided by EayOK Services are
resold. Thus, certain equipment, routing, software, and programming
used by EayOK Hosting Services are not directly owned or written by
EayOK Hosting Services. EayOK Hosting SErvices holds no responsibility
for the use of our clients accounts. If any terms or conditions are
failed to be followed, the account in question will be automatically
deactivated. We reserve the right to remove any account without
advanced notice for any reason without restitution
as EayOK Hosting Services sees fit.
- You warrant and represent to EayOK
Hosting Services that you are: at least eighteen 18 years of age; you
possess the legal right and ability to enter this agreement; you will
use the Plan (s) only for lawful purposes and remain in accordance
with this Agreement and all policies and guidelines that may apply;
you will be financially responsible for your Subscription (s); you
have acquired, or will acquire all necessary arrangements for
hypertext links to a third party Web sites or other content; you have
verified or will verify the accuracy of materials distributed or made
available through use of the Plan (s), including, without limitation,
your content, claims, warranties, guarantees, nature of business, and
address where business is conducted, and your content does not
infringe or violate any right of any third party (including
intellectual property rights) or violate any applicable law,
regulation or ordinance.
Account Activation
The activation of your account is the payment you made for your hosting
plan. By activating/paying for your subscription to your account with
EayOK Hosting Services (EayOK Hosting on the Net), you agree to the above policies and disclaimer.
Upon requesting/paying for an account activation, you are required to
accept these policies, guidelines, and disclaimer and a copy of your
acceptance is forwarded along with your activation request/payment to be
maintained within your account information.
No refunds will be given after your first 30 days on our servers.
EayOK Hosting Services retains the right to change any or all of the
above Policies, Guidelines, and Disclaimer without notification.
